Terms of Sale and Use

The terms governing your use of QRstop: static and dynamic QR codes, scan tracking, the subscription and the applicable law.

1. Publisher, contact and hosting

1.1 https://www.qrstop.com and the QRstop service are published by QRStop Solutions Limited (C 116839), whose registered office is at . Correspondence regarding these Terms is received at [email protected].

1.2 The Site is hosted by OVHcloud (OVH SAS)., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus (https://www.ovhcloud.com).


2. Terms used in these Terms

2.1 The following words have the meanings set out below.

Customer
Any individual or legal entity subscribing to the Services, whether as a consumer or in a professional capacity.
Account
The secure personal area from which QR codes are created, edited and tracked.
Static QR Code
A code that encodes the chosen destination directly, with no redirection by QRstop.
Dynamic QR Code
A code that encodes a redirection link provided by QRstop, whose destination can be changed after printing.
Destination
The address or content to which a QR code sends the person scanning it.
Scan
The reading of a QR code by a device, recorded by QRstop in the case of a Dynamic QR Code.
Trial Offer
The paid introductory period described in clause 10, at the end of which the monthly subscription begins.

3. Scope and acceptance

3.1 These Terms govern the entire relationship between QRstop and the Customer, to the exclusion of any other document. Subscribing constitutes unreserved acceptance.

3.2 QRstop may amend these Terms. The version that applies is the one in force on the date of the order; any material change is notified by email at least thirty (30) days before it takes effect.

3.3 The Services are available only to persons aged eighteen (18) or over who have legal capacity to contract.


4. Purpose of the Services

4.1 QRstop provides an online platform for creating, customising, managing and tracking QR codes.

  • generating static and dynamic QR codes from a range of content types;
  • visual customisation of codes, including colours, module styles and the addition of a logo;
  • exporting codes in the raster and vector formats offered by the Service;
  • changing the Destination of a Dynamic QR Code after it has been distributed;
  • scan statistics for Dynamic QR Codes;
  • email support.

4.2 The Customer is solely responsible for the Destination they associate with a QR code and for the content it leads to.


5. Static and dynamic QR codes

5.1 A Static QR Code encodes the Destination directly. It keeps working independently of the Account and the subscription, as QRstop plays no part in reading it.

5.2 A Dynamic QR Code relies on a redirection link operated by QRstop. The redirection and its statistics work only for the duration of the subscription: once it ends, dynamic codes stop resolving to their Destination.

5.3 Customers should take this into account before any printing or large-scale distribution, and should keep their own exports.

5.4 QRstop may change the technical redirection infrastructure, provided that active dynamic codes continue to work.


6. Acceptable use

6.1 The Customer warrants that they hold the necessary rights over the content they distribute and over the Destinations they associate with their codes.

6.2 QR codes leading to unlawful, misleading or fraudulent content are prohibited, in particular phishing, distribution of malware, impersonation of a third party, and substituting a code for that of a merchant or a public body.

6.3 The Customer must not circumvent the technical limits of the Service, automate its use abusively, or disrupt its operation.

6.4 QRstop may disable without notice any QR code for which there are serious indications of use contrary to this clause, and may comply with requests from the competent authorities.


7. Account and credentials

7.1 Access to the Services requires the creation of an Account. The Customer provides accurate information and keeps it up to date.

7.2 Credentials are personal and confidential. The Customer is responsible for all activity carried out from their Account and must inform QRstop without delay, at [email protected], of any unauthorised use.


8. Customer content and licence

8.1 The Customer retains all rights in the logos, trade marks and content they upload.

8.2 They grant QRstop a non-exclusive licence, limited to the duration of the subscription and to what is strictly necessary to host, process and display those materials as part of the Service.

8.3 The QR codes generated and their exports may be used freely by the Customer, including for commercial purposes, subject to compliance with these Terms.


9. Price, taxes and payment

9.1 Prices are stated inclusive of all taxes, in the currency displayed at the time of the order. The applicable tax is that of the Customer's country of residence under the rules governing electronically supplied services.

9.2 Payment is made by payment card or by any other means offered at the time of the order. The Customer authorises QRstop to charge that payment method on the agreed due dates.

9.3 Charges appear on the Customer's statement under the descriptor QRstop.com. Billing queries should be sent to [email protected].


10. Trial Offer and subscription

10.1 Access begins with a Trial Offer of ₱61.60 giving access to the Services for 48 hours from subscription.

10.2 At the end of the Trial Offer, and unless cancelled before that point, the monthly subscription begins automatically at ₱3,353.56 per month, charged on the same date each month.

10.3 The subscription has no minimum term and may be cancelled at any time from the Account, on the terms set out in the Subscription Terms.


11. Right of withdrawal

11.1 A consumer Customer resident in the European Union has fourteen (14) days in which to withdraw, without giving reasons and without penalty.

11.2 By requesting immediate access to the Services when ordering, the Customer expressly requests performance of the contract before that period expires and acknowledges losing the right of withdrawal once the service has been fully performed, in accordance with applicable consumer law.

12. Availability, liability and force majeure

12.1 QRstop endeavours to keep the Services and redirections accessible at all times, subject to maintenance and to incidents affecting third-party networks and providers.

12.2 QRstop is not liable for indirect loss, in particular loss of business or reputational harm resulting from the temporary unavailability of a redirection.

12.3 In any event, QRstop's liability is limited to the sums actually paid by the Customer during the twelve (12) months preceding the event giving rise to the claim.

12.4 Neither party is liable for non-performance resulting from an event of force majeure.


13. Intellectual property

13.1 The QRstop brand, the Site, its architecture, its content and its developments remain the exclusive property of QRStop Solutions Limited (C 116839).

13.2 The Customer is granted a personal, non-exclusive and non-transferable right to use the Services for the duration of their subscription.


14. Personal data

14.1 The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

14.2 Scan tracking relies on limited, non-identifying data. Where the Customer points a QR code at a form or a service that collects personal data, they act as controller of that processing.

14.3 Any request relating to personal data should be sent to [email protected].


15. Suspension and termination

15.1 The Customer may cancel their subscription at any time from their Account; cancellation takes effect at the end of the current period.

15.2 Customers are reminded that once the subscription ends, Dynamic QR Codes stop resolving to their Destination, whereas Static QR Codes already exported keep working.

15.3 QRstop may suspend or terminate access in the event of a breach of these Terms, in particular clause 6, of non-payment, or of fraudulent use.


16. Governing law and disputes

16.1 These Terms are governed by the law of Malta, without prejudice to any more protective mandatory provisions of the consumer's country of residence.

16.2 The Customer should send any complaint to [email protected]. Failing an amicable solution, a consumer resident in the European Union may use the European online dispute resolution platform.

16.3 Failing amicable resolution, the courts of Malta have jurisdiction, subject to the protective jurisdiction rules applicable to consumers.
